The acquisition of rental management of special property includes services as:

Allgemeine Geschäftsbedingungen
1. Geltungsbereich
Die nachstehenden Allgemeinen Geschäftsbedingungen (AGB) gelten in der jeweils aktuellen Fassung für alle Geschäfte der ARTE IMMOBILIEN e. Kfm., Inhaber Thorsten Schache, AG Charlottenburg – HRA 29134 - (nachstehend ARTE genannt) und zwar unter vollständigem Ausschluss anderer, nicht ausdrücklich und zwingend schriftlich von uns genehmigter AGB; der Geltung von Geschäftsbedingungen des Kunden wird hiermit ausdrücklich widersprochen. Diese ausgeschlossenen abweichenden AGB des Vertragspartners oder Dritter, insbesondere Einkaufs- und Zahlungs- sowie sonstige weitere AGB erkennen wir selbst dann nicht an, wenn sich die Verwender ausdrücklich nur unter Geltung dieser anderen AGB binden wollen. Von diesen AGB abweichende Regelungen bedürfen der schriftlichen Vereinbarung. Spätestens mit der bestimmungsgemäßen Entgegennahme unserer Leistung gelten unsere AGB als angenommen, auch wenn sie nicht bei jedem einzelnen späteren Geschäft besonders dargetan werden. Mit der Entgegennahme der Leistung gelten auch sonstige – z.B. in Exposés enthaltene – Angebote als angenommen. Die AGB sind in ihrer jeweils aktuellsten Fassung im Internet veröffentlicht.
2. Auftragserteilung, Bestellung und Leistung
Unsere Tätigkeit für Kunden ist provisionspflichtig. Unsere Angebote sind freibleibend und unverbindlich. Die Verbindlichkeit von Angeboten bis zu bestimmten Terminen oder für längere Fristen ist besonders abzureden und abhängig von unserer ausdrücklichen schriftlichen Genehmigung. Der Auftrag des Bestellers ist ein bindendes Angebot. Wir sind berechtigt, dieses Angebot binnen 4 Wochen nach seiner Abgabe anzunehmen. Wir sind regelmäßig gleichzeitig im Auftrag von Veräußerer und Erwerber tätig, der Kunde ist damit einverstanden. Wir sind dabei auch für Gläubiger des Veräußerers (z.B. kreditgebende Banken des Veräußerers) tätig, auch hiermit ist der Kunde einverstanden.
3. Vorkenntnis
Ist dem Kunden ein Vermittlungsobjekt bereits als verfügbar bekannt, hat er dies unverzüglich, längstens jedoch innerhalb von fünf Werktagen, schriftlich anzuzeigen. Dem Kunden obliegt der Nachweis der Vorkenntnis. ARTE weist darauf hin, dass auch im Falle einer Vorkenntnis des Kunden der Provisionsanspruch für Vermittlungstätigkeit im Sinne des § 652 BGB anfällt, wenn ARTE mit Kenntnis des Kunden Verhandlungen über die Verwertung des Objekts führt. Die Vermittlungstätigkeit der ARTE für den Kunden wird widerlegbar vermutet, wenn der Kunde nicht mit der Anzeige seiner Vorkenntnis schriftlich erklärt, dass er an einer weiteren Tätigkeit der ARTE kein Interesse hat.
4. Vertraulichkeit
Der Kunde ist verpflichtet, die ihm überlassenen Informationen und Unterlagen zu Objekten vertraulich zu behandeln. Die Weitergabe ist nur mit vorheriger schriftlicher Einwilligung der ARTE zulässig; für die Tätigkeit der ARTE bleibt der Kunde gleichwohl provisionspflichtig, bis ARTE schriftlich die Entbindung von der Verpflichtung bestätigt. Es ist im Falle der Weitergabe Sache des Kunden, im Verhältnis mit dem Informationsempfänger die Pflicht zur Tragung der Provision zu klären. Die unbefugte Weitergabe verletzt die Rechte der ARTE und möglicherweise auch weiterer Parteien. Kommt es aufgrund einer unbefugten Weitergabe zum Abschluss eines Geschäftes, so haftet der Kunde gegenüber ARTE unbeschadet weitergehender Ansprüche für die Zahlung der Provision oder die durch Weitergabe entgangene Provision.
5. Provision, Fälligkeit, Ersatzgeschäfte
Die Höhe der vom Kunden an ARTE zu zahlenden Provision beträgt bei Kauf oder sonstigem Erwerb eines Objekts 7,14 % des Kaufpreises zuzüglich der jeweils gesetzlich gültigen Umsatzsteuer, derzeit 19%; bei sonstigem Erwerb gilt der zwischen Veräußerer und Erwerber vereinbarte Wert, in Ermangelung eines solchen Wertes gilt der Verkehrswert. Kommt zwischen den Parteien keine Einigung über den zugrunde zu legenden Wert zustande, hat ein vom Präsidenten der IHK zu Berlin zu benennender Sachverständiger diesen Wert zu ermitteln. Bei Geschäften, die für den Kunden nicht zu einem Erwerb, sondern zu einer nutzungszeitabhängigen Leistung führen (z.B. Miete, Pacht, Erbpacht etc.) beträgt die Provision die Summe aus drei Monatsbeträgen, zuzüglich der auf diesen Betrag entfallenden gesetzlich gültigen Umsatzsteuer, derzeit 19%, die bei etwaig abweichendem Abrechnungszeitraum durch Umrechnung aus der Grundlaufzeit des Nutzungsvertrags festzustellen sind. Bei gemischten Erwerbs- und Nutzungsgeschäften fallen die Provisionen in ihrem Verhältnis gemäß den vorstehenden Regelungen bezogen und berechnet auf den jeweiligen Leistungsteil an. Der Kunde hat beim Abschluss notarieller Verträge für die Aufnahme einer Maklerklausel (z.B. durch Einräumung der Mitwirkung des Maklers an der Urkunde zu eigenem Anspruch oder durch Regelung eines Anspruchs zugunsten des Maklers als Drittem auf Zahlung von Provision) einzutreten.
Ein Provisionsanspruch bleibt auch bestehen, wenn der abgeschlossene Vertrag unwirksam wird (z.B. durch auflösende Bedingung, Rücktritt, Aufhebung o.ä.) oder das ursprünglich angestrebte Geschäft durch ein weiterhin auf das Objekt bezogenes anderes ersetzt (z.B. Miete oder Erbpacht statt Kauf oder umgekehrt; Kauf von Anteilen einer Objekt-Gesellschaft statt Grundstückskauf) und/oder beschränkt oder erweitert wird. Der Erwerb ist und/oder bleibt auch dann provisionspflichtig, wenn das Objekt durch den Kunden von einem Insolvenzverwalter oder aus der Zwangsversteigerung heraus erworben wird und ARTE vermittelnd zwischen Veräußerer(n) und/oder Gläubiger(n) und dem Kunden tätig geworden ist.
Die Provision ist mit dem Zeitpunkt des Abschlusses des nachgewiesenen oder vermittelten Geschäfts fällig. In den Fällen, in den ARTE für Veräußerer und Erwerber tätig wird, tragen diese die vorstehend geregelten Provisionen je zur Hälfte. Entsprechendes gilt, wenn ARTE an Stelle des Veräußerers für einen Gläubiger im Sinne der oben stehenden Ziffer 2. tätig wird und eine Provision erhält.
6. Quellen, Haftung
Unsere Angaben basieren grundsätzlich auf verlässlich erscheinenden Quellen, sind aber nicht überprüft, wenn nicht etwas anderes bestätigt wird. Eine Haftung wird deshalb nur dann übernommen, sofern dies von uns ausdrücklich schriftlich erklärt wird. Dies gilt auch für die Verfügbarkeit der mitgeteilten Objekte. Es ist allein Sache des Kunden, die Angaben auf Vollständigkeit und Richtigkeit zu prüfen und sich dabei rechtzeitig vor Vertragsabschluß jeweils von sachverständigen Berufsträgern rechtlich, steuerlich, wirtschaftlich und technisch beraten zu lassen. Unsere Haftung ist, soweit gesetzlich zulässig, ausgeschlossen; wir haften auch nicht für mittelbare Schäden, Mangelfolgeschäden oder entgangenen Gewinn; die Haftung für vorsätzliches oder grob fahrlässiges Verhalten bleibt unberührt. Im Falle der Verletzung einer wesentlichen Vertragspflicht haften wir darüber hinaus für leichte Fahrlässigkeit. In diesen Fällen wird jedoch nur der vertragstypische, vernünftigerweise vorhersehbare, nicht aber ein unüblicherweise entstehender Schaden ersetzt, insbesondere kein entgangener Gewinn oder sonstige Vermögensschäden des Geschäftspartners, auch wenn eine Haftungshöchstgrenze nicht vereinbart wurde. Soweit unsere Haftung ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung unserer Angestellten, Arbeitnehmer, Mitarbeiter, gesetzlichen Vertreter und Erfüllungsgehilfen.
7. Erfüllungsort, Gerichtsstand, anwendbares Recht
Erfüllungsort und Gerichtsstand für alle Rechtsstreitigkeiten aus diesem Vertrag und allen sonstigen Parteibeziehungen ist, soweit gesetzlich zulässig, Berlin. Wir sind berechtigt, auch am Wohnort, am Geschäftssitz oder dem Ort der Niederlassung des Kunden zu klagen. Es ist ausschließlich das Recht der Bundesrepublik Deutschland anzuwenden.
8. Schlussbestimmungen
Sollten eine oder mehrere Bestimmungen dieser AGB unwirksam sein oder werden oder die AGB eine Regelungslücke enthalten, bleibt die Gültigkeit der übrigen Bestimmungen davon unberührt.

The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription when said data will be deleted. Data we have stored for other purposes (e.g. email addresses for the members area) remain unaffected.
